General conditions of use of the Bricchi de mâ platform

 

I. Bricchi de mâ

Bricchi de mâ is a platform (hereinafter “Platform”) that allows you to search for and book Experiences such as entrances, guided tours, itineraries, festivals, conferences, workshops, courses, events, services, etc. (hereinafter “Experiences”) within the territory of the localities of Tigullio Liguria (hereinafter “Locations”).
The services offered by the Platform allow you to directly contact the Institutions (e.g. Parks, Municipalities, etc.), with public or private Organizations (e.g. Associations, Cooperatives, Foundations, Companies, etc.), and with the operators (e.g. Guides, Professionals, etc.) (hereinafter collectively “Partners”), who promote, organize and manage the Experiences. In addition to informing you, Bricchi de mâ allows you to book, free of charge or for a fee, your participation in the Experiences offered by the Partners. Bricchi de mâ does not organize or manage the Experiences proposed by the Partners, nor does it act as an organizer of travel packages. We do not provide transportation or travel; we do not own or participate in any Partner, Entity or Organization of the Experiences offered through the Platform, nor are we economically controlled by any of them.

 


II. About us

Bricchi de mâ is a registered trademark owned by J’eco srl (“J’eco”) Fiscal Code and VAT number 03328060987, with registered office in Brescia (BS), via Bezzecca, 10 and operational headquarters in Milan (MI), via Lorenteggio 177. J’eco is the owner of the website www.bricchidema.it (the “Platform”). J’eco manages the services and functions of the Platform and administers the activities by providing services to Partners and End Users.
The execution and methods of use of the Experiences (e.g. a hiking or food and wine route, an educational workshop, etc.) are not the subject of the service offered by the Platform, but the content of a contract stipulated between You and the Partner who proposes the Experience. We are therefore not responsible for the execution and methods of execution of the Experiences that are offered to You. Free and/or paid reservations made through the Platform see, as parties, the Partner and You, in the capacity of the person who makes the reservation for purposes not related to his/her entrepreneurial, commercial, artisanal or professional activity (hereinafter the “User”), (Partner and the User are hereinafter collectively referred to as the “Parties”). Limited to the sole activities of issuing the electronic reservation code and for the purchase procedure, J’eco acts on the specific mandate of the Partner and in its name.

 


III. These Terms of Use.

These General Terms and Conditions of Contract and Use govern, together with our data protection rules, the use of the services made available through the Platform and represent the fundamental basis of the usage relationship between You and the Partner in relation to the search services and any free or paid booking of the Experiences proposed and organized by the participating Partners.
Separately and complementary, the Partners’ conditions are applied when you purchase tickets and/or services from them, offered directly on the pages of their sites, to which you may be redirected via specific links on the Platform. Bricchi de mâ has no influence on these conditions applied.
Bricchi de mâ does not own, create, control, manage or provide Experiences. The participating Partners are exclusively responsible for the services and Experiences promoted by them. The contract for the use of the Experience is perfected only with the respective Partner. Bricchi de mâ is not, nor does it become a party or otherwise participate in any contractual relationship between You and the Partner, nor does it act as an agent in any capacity. The booked Experiences (contract conditions and any regulations) are therefore subject exclusively to the responsibility of the respective Partners with the consequence that any cancellations and/or changes to the booking will also be managed directly by the Partners themselves.

 


IV. The services offered by Bricchi de mâ.

Our services are designed to provide you with the information needed to verify your Experiences made available on the Platform by Partners and to plan your Experience in a simple and effective way. In particular, Bricchi de mâ services are:

1. Search engine.

We illustrate Locations and Experiences (e.g. hiking trails, food and wine trails, educational workshops, entrance fees, guided tours, festivals, conferences, courses, events, services, etc.) promoted by participating Partners, which we determine on the basis of your geographic location and/or your search filters, in a detailed representation including various information (e.g. duration, accessibility, possible booking, cost, etc.). We cannot assume the guarantee for the completeness or correctness of the results; we therefore rely on the information made available on the Platform by the Partners themselves.

2. Direct interaction with Partners

The pages of the Experiences presented on Bricchi de mâ may include links through which you can access the websites of the Partners and use the services, including booking, offered by the respective Partners. Through this function, you can interact and relate directly with them, making, where possible, your booking of the Experience directly with them. If the booking involves a payment, the same is made through the payment system indicated on their website, under the conditions and terms provided therein. We do not receive any commission from the participating Partners.

3. Direct bookings on our Platform.

For some Experiences, Bricchi de mâ offers you the possibility, directly on the Platform, to: a) book the Experience free of charge (hereinafter “Free Booking”); or, where possible, b) book and also make the advance payment for the Experience online (hereinafter “Paid Booking”).
In both cases, your navigation is not redirected to the websites of the respective Partners, but takes place via the Platform.
In compliance with our data protection provisions, when you book an Experience via the Platform, whether paid or free, we collect and communicate the useful and necessary data (e.g. your name, email, number of participants, etc.) to the respective Partner to allow you to enjoy the Experience. In order to reduce the operational margins of error, each of your bookings is completed via confirmation, which you receive via email, to the address provided by you during the procedure.

3.1 Free booking:

3.1.1 For some Experiences on the Platform, you can make a free Reservation by filling out the appropriate reservation form. To complete the reservation form and allow the completion of Your reservation, You are asked to: indicate the number of participants; provide the data of the participants (email address, name, surname, age, etc.) and confirm that none of the participants are subject to measures that prohibit their participation.
3.1.2 Before confirming and sending the form, you can modify/correct the data: therefore, after careful reading, you are required to expressly approve these General Conditions, by means of the appropriate check mark (check-box), available on the Platform.
3.1.3 For each reservation, You will receive an email confirming Your reservation at the email address You provided, containing:
– an automatically generated electronic reservation code or, in other cases, a unique reservation code or a voucher; documents that you will have to present at the check-in location (Ticket Office) before the start of the Experience offered by the Partner, to physically redeem the valid document for participation (e.g. ticket, etc.);
– any additional instructions requested by the Partner for participation in the Experience.

3.2 Paid booking:

3.2.1 For some of the Experiences presented on the Platform, you can make a paid reservation by filling out the appropriate reservation and purchase form. In order to make the reservation and purchase of the Experience, in particular, you are required to: indicate the number of participants; provide the data of the participants (email address, name, surname, age, etc.); choose between the payment methods indicated and, finally, make the payment in order to complete the order and finalize your reservation.
3.2.2 Before making the payment, you are offered the view of a summary of the order, in which you can modify/correct the data before sending: therefore, after careful reading, you are required to expressly approve these General Conditions, through the appropriate check mark (check-box) and, finally, through the “Confirm reservation with obligation to pay” button, proceed with the payment.
3.2.3 Upon completion of each payment, you will receive, at the email address you provided, an email confirming your booking containing:
– an automatically generated electronic booking code or, in other cases, a unique booking code or a voucher that you will have to present at the check-in location (Ticket Office) before the start of the Experience offered by the Partner, to physically redeem the valid document for participation (e.g. ticket, etc.);
– any further instructions requested by the Partner for participation in the Experience; as well as
the information relating to the Partner’s Customer Service contacts to whom you can contact to request assistance and/or submit complaints.
– the order confirmation email, which contains a link to these General Conditions, constitutes confirmation of the contract concluded on a durable medium pursuant to art. 51, paragraph 7, of the Consumer Code.
3.2.4
We ask you to promptly check any document that has been sent to you. You are required to immediately report any errors or incorrect information by contacting our Assistance Center, reachable at the web address: https://www.bricchidema.it/centro-assistenza, following the procedure set out in the following point V.

3.3 Payments

3.3.1 Before proceeding with payment, you are asked to choose the payment method you prefer from those available. If you decide to use the immediate payment method (at the time of purchase) by credit card, PayPal/Strype or immediate bank transfer, you are required to communicate the relevant data via a secure connection. The reservation is considered accepted only after receiving confirmation of payment. We are appointed and authorized by the Partner to collect payments.

3.4 Cancellation of the Experience for reasons not attributable to you – Exclusion of the Right of Withdrawal.

3.4.1 Bricchi de mâ is not, nor does it become a party or otherwise participate in any contractual relationship between You and the Partner. Limited to the sole activities of issuing the electronic booking code and for the purchase procedure, it acts on the specific mandate of the Partner.
3.4.2 In the event of cancellation of an Experience carried out pursuant to art. 3.2 (Paid Booking), for reasons not attributable to You (e.g. cancellation of the Experience due to failure to reach the minimum number of participants and/or due to the Partner’s subsequent impossibility to carry out the Experience, force majeure, provisions of the competent Authorities) Bricchi de mâ is not responsible for any cancellation of the Experience by the Partner.
You will receive a notification email from the Partner or, where possible, from assistenza@bricchidema.it containing the initiatives that the Partner has adopted in relation to the cancelled Experience

3.4.3 Exclusion of the Right of Withdrawal. In accordance with the provisions of the contracts for the supply of services relating to leisure activities that the Partner undertakes to provide on a specific date (pursuant to art. 59, paragraph I, letter n) Legislative Decree 6 September 2005, no. 206 “Consumer Code”), as a rule, the right of withdrawal provided for by art. 52 of the Consumer Code does not apply to the contract and therefore you will not be able to exercise this right in relation to the purchase of your booking.

 


IV. Registration

To make a reservation and to access the services offered by the Platform, we ask you to register a personal account or share some of your contact details. You will then be able to access your individual profile by entering a valid email address and a password. All your personal data is processed in accordance with our Data Protection Policy (https://www.bricchidema.it/privacy-policy/). Only natural persons of legal age and with full legal capacity can register as users of our services. It is your responsibility to maintain the confidentiality and security of the access credentials to your Account and not to disclose them to third parties. Please notify us immediately of any possible behavior that could create security gaps and any possible misuse of your account. Bricchi de mâ cannot be held liable for any damage caused by unauthorized use of an account. When you register, you are required to enter the necessary information in a complete, correct and truthful manner and, if necessary, to update it. Registration is not transferable. Deactivation of the account for inactivity: If you do not use the services for a period of time exceeding 24 consecutive months, Bricchi de mâ has the right to deactivate your Account and subsequently delete it without giving you further specific notice.

 


V. Help Center – Customer Care

To access the Help Center, we ask you to register a personal account, which you can access by entering your valid email address and password. Any personal data of yours is processed in accordance with our Data Protection Policy (https://www.bricchidema.it/privacy-policy/). Only natural persons of legal age and with full legal capacity can register as users of our services. It is your responsibility to maintain the confidentiality and security of the access credentials to your account and not to disclose them to third parties. Please notify us immediately of any possible behavior that could create security gaps and any possible misuse of your account. When you register, you are required to enter the necessary information in a complete, correct and truthful manner and, if necessary, to update it. The registration is not transferable. Deactivation of the account due to inactivity: If you do not use the services for a period of time exceeding 24 (twenty-four) consecutive months, Bricchi de mâ has the right to deactivate your account and subsequently delete it without giving you further specific notice.

 


VI. Limitations of functionality of the Platform

We have the right to make changes to the content or functionality of the Platform at any time (e.g. through patches, updates or modifications) and do not guarantee the continuous accessibility of our pages. In particular, technical problems beyond our control may lead to interruptions of the services, as well as maintenance interventions may affect their availability. These are carried out in the least intrusive manner possible. We continuously strive to ensure flawless and uninterrupted technical operation of our services. However, we cannot assume any liability for the timely and uninterrupted accessibility or usability of our offer.
You are required to take appropriate measures of use. In the case of the use of hyperlinks to third parties, Bricchi de mâ assumes no responsibility for third-party content, nor does it have any obligation to monitor the same.

 


VII. Obligations and duties of the User, warnings

As a User, you are responsible for complying with all formalities relating to the use of the Experience booked by you (age requirements, entry regulations, vaccinations and other health requirements). Although we take care to inform you of the warnings known to us, it is your responsibility to take note of the individual regulations of each Location and Partner, in order to use the services and their Experiences.

 


VIII. Limitation of liability of Bricchi de mâ

We make every effort to ensure the accuracy of the information contained on all our pages. For the details of the Locations, Experiences or services, we rely on the information provided by the respective Partners. We are not able to fully verify the accuracy and topicality of the information we collect and present. A check by us takes place only when necessary. We therefore ask you to personally check the individual access/visit information and, if necessary, report to us any illegal and/or incorrect/true content. The same applies to all other information that the Partners present in relation to the Experiences. We are not involved in the presentation or description of the visit or excursion services by the Partners and are therefore not responsible for the content offered therein or for the contracts concluded with them. Any warranty rights or claims for damages must be asserted exclusively against the Partners. Our offer contains links to other websites that we do not operate or control directly and for which we are not responsible. We do not endorse the content of these other websites and assume no responsibility for the legality or functionality of such content nor are we liable for any loss or damage that may arise from the use of these pages. We recommend that you carefully read the general conditions of the respective web pages to which the Platform may link.

 


IX. Data protection

The processing of your data when using our services is subject to our data protection regulations (https://www.bricchidema.it/privacy-policy/).

 


X. Copyrights

All intellectual property rights of any content on the Bricchi de mâ website belong to the Partners or to Bricchi de mâ, unless otherwise expressly stated.
Except for uses necessary for the use of the Platform services, you therefore declare that you will not download, upload, copy, print, reproduce or use in any way, in whole or in part, the contents of the Platform without written permission from the Partner or Bricchi de mâ.

 


XI. Applicable law

These terms of use are governed by Italian law and must be interpreted in accordance with such legislation. Any dispute relating to these General Conditions is governed and interpreted in accordance with Italian law and in particular by Legislative Decree 6 September 2005 n. 206, Consumer Code, with specific reference to the legislation on distance contracts and by Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.
For all disputes relating to these General Conditions, the Court of the place of domicile or residence of the consumer user is competent based on the applicable law, or at the choice of the same, the Court of Brescia.
Alternatively, the Customer may choose to access the platform for the extra-judicial resolution of disputes provided by the European Commission, present on the site http://ec.europa.eu/odr.
